Supervisors score hog confinement permit application

The Cass County Supervisors approved the scoring of a construction permit application for a hog finishing facility, P38 Finishers, owned by Prestage Farms of Iowa, LLC, which is planned to be located in Cass County in Lincoln Township. They plan to make their recommendation on the application during next week’s meeting.
The application needed a minimum of 440 total points to be approved, and after going through the application question by question, the supervisors agreed that it had scored 470 total points, 30 points above the minimum required.
Written comments may be sent to the Cass County Auditor’s office until 4:30 p.m. on March 20, and supervisors said some limited public comment would be allowed during the Wednesday, March 21 open meeting, but a public hearing is not planned.
Scoring of the application had been put off at previous supervisor meetings because of questions regarding DNR involvement in the scoring of the first 10 questions on the application and about minimum distance separation issues regarding the Dave Nichols residence.
Nichols, who is selling Prestage Farms the property that the hog finishing operation will be built on, had signed filed waiver saying his property should be excluded from the minimum separation distance. At last week’s meeting, Lynn Collins Seada, attorney for Prestage Farms of Iowa, explained that Nichols property should be excluded and that the waiver was anticipatory. She said that Nichols, as current owner of the property, was exempt from the minimum distance rules, but that the waiver was filed because Prestage Farms would be purchasing the property, and the waiver would ensure that the property was still exempt after the property changed hands.
It was noted yesterday that the warranty deed on the property had been transferred from Nichols to Prestage Farms of Iowa on March 12, and that a survey had been done, but needed some minor corrections due to typographical errors in nomenclature.
Cass County Attorney Dan Feistner said he had spoken to Randy Clark, with the DNR who told him that the DNR, due to some recent changes, was no longer involved in scoring the first 10 questions on the application, but could answer some questions about minimum separation distance, and said the board could go ahead with plans to score the application.
Feistner also said he had verified that changes had been made to the survey, and that the corrected survey was in the process of being submitted.
After running through all of the questions on the application, the board decided that the application had scored the necessary points.
